1. Agreement to Terms

By accessing or using the Stability web application ("Service") operated by Stability Engineering Pty Ltd ("Stability", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Stability provides civil and structural engineering calculation tools, including soil classification (AS2870), wind classification (AS4055), bearing capacity analysis, and related engineering reports. The Service is designed for use by qualified engineers in Australia.

3. Account Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Ensuring the accuracy of information you provide
  • Notifying us immediately of any unauthorised use of your account

4. Payment Terms

Certain features of the Service, such as generating engineering reports, require a one-time payment. All payments are processed securely through Stripe. Prices are displayed in Australian Dollars (AUD) and include GST where applicable.

Payments are non-refundable once a report has been generated, except where required by Australian Consumer Law.

5. Intellectual Property

Your Data: You retain full ownership of all data you input and all reports generated from your data. You may use, download, and distribute your reports as you see fit.

Our Service: The Stability platform, including its design, code, calculations, templates, and branding, is the intellectual property of Stability Engineering Pty Ltd. You may not copy, modify, or distribute any part of the Service itself.

6. Engineering Disclaimer

Important Notice

The calculations and reports provided by Stability are tools to assist qualified engineers. They are not a substitute for professional engineering judgement.

Users are responsible for verifying all outputs, ensuring calculations are appropriate for their specific project conditions, and exercising independent professional judgement. All engineering work must be reviewed and certified by a suitably qualified and registered engineer.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Share your account credentials with others
  • Use automated tools to scrape or extract data from the Service

8. Limitation of Liability

To the maximum extent permitted by Australian law, Stability Engineering Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but previously purchased reports remain yours.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
